The Instruction
Our client was involved in a boundary dispute concerning the position of a fence between two residential properties on Lloyd Avenue, Coulsdon.
Stokemont’s Boundary Surveying team were instructed to investigate the disputed boundary and provide an independent Boundary Surveyor’s Report and Determination.
The purpose of the instruction was to assess the available evidence and provide a reasoned professional opinion regarding the position of the boundary.
The Property
The property formed part of an established semi-detached residential development in Coulsdon.
The boundary in question was defined in part by fencing between the properties. As with many residential boundary disputes, the position of the existing fence could not necessarily be assumed to represent the legal boundary.

The position and arrangement of the existing fencing and other physical features were inspected and recorded as part of the assessment.

We advised the client on the evidence relevant to the boundary dispute and prepared a Boundary Surveyor’s Report setting out our findings.
The assessment considered the relationship between the documentary evidence, historical information and physical features observed during the site inspection.
Where the position of an existing fence is disputed, it is important not to assume that the fence itself establishes the legal boundary. A proper boundary assessment requires consideration of the available evidence and the circumstances in which the boundary was originally created.
