What is the Party Wall Act?

The Party Wall etc. Act 1996 is legislation designed to help prevent and resolve disputes relating to certain types of construction work affecting shared walls, boundaries, and neighbouring properties.

The Act applies throughout England and Wales and provides a legal framework for carrying out qualifying works while protecting the interests of neighbouring owners.

Why Party Wall Surveyors are Commonly Needed in South London

South London is a residentially diverse area, containing large volumes of Victorian terraces, Edwardian properties, converted flats, and closely spaced residential homes. As such, many common home improvements, including loft conversions, rear extensions, basement excavations, and structural alterations, can fall under the legal obligations set out in the Party Wall etc. Act 1996.

Whether you’re extending a family home in Wandsworth, renovating a tenant’s flat in Brixton, or converting a loft in Lambeth, seeking expert party wall advice early helps ensure a smoother process and reduce the likelihood of unnecessary delays and neighbourly disputes.

Our surveyors regularly advise building and adjoining owners in South London, ensuring all works progress in line with the relevant legislation.

Types of Work Covered by the Party Wall Act

Many residential and commercial building projects carried out across South London can fall under the Party Wall etc. Act 1996. Common examples include:

Works to a Party Wall or Shared Structure

Construction work involving a shared wall or structure may fall under the Party Wall etc. Act 1996. Common examples include removing chimney breasts, inserting steel beams, increasing the height of a party wall, or carrying out structural alterations as part of loft conversions and home extensions.

Excavations Near Neighbouring Properties

Excavation work carried out close to neighbouring structures may trigger party wall procedures where foundations are affected. This often applies to projects such as basement excavations, rear and side extensions, and other substantial groundworks.

Construction on Boundary Lines

The Party Wall etc. Act 1996 may also apply where new walls are constructed at, or astride, the boundary line separating neighbouring properties.

What Happens When You Hire a Party Wall Surveyor?

Every party wall matter follows a structured legal process designed to protect the interests of both building owners and adjoining owners while allowing works to proceed. Whether you’re planning a loft conversion, rear extension, or larger development in South London, the process remains the same.
Third Surveyor

Initial Advice

Your Party Wall Surveyor will assess the proposed works and establish whether the Party Wall etc. Act 1996 applies, explaining any legal obligations before the project progresses.
By Hand

Notice Served

A Party Wall Notice will be prepared and served to the affected adjoining owner.

Consent or Dissent

The adjoining owner can either consent to the proposed works or dissent and appoint their own surveyor.

Surveyor Appointed

Where an adjoining owner does not consent to the proposed works, one or more party wall surveyors are appointed to assess the project and prepare a Party Wall Award setting out the rights and responsibilities of each party.

If the appointed surveyors cannot reach an agreement, a third surveyor may be called upon to determine the matter.

Party Wall Award

Once an agreement is reached between the appointed surveyors, a legally binding Party Wall Award is prepared, setting out the terms under which the proposed works can proceed.

South London Party Wall Surveyor FAQs

Closed
Does my loft conversion require a party wall surveyor?
While not necessary in every case, there are situations where a loft conversion requires a party wall surveyor. If proposed works involve cutting into a shared wall, inserting steel beams, or raising an existing party wall, then the rules and requirements of the Party Wall etc. Act 1996 may apply.

As loft conversions are common across many of South London’s Victorian terraces and semi-detached homes, seeking professional advice before beginning work is recommended.

Can I start building work before a Party Wall Award is agreed?
It is not advisable to begin any construction works before a Party Wall Award has been agreed in cases where one is required. A Party Wall Award outlines the legal terms to which both the building owner and the adjoining owner must adhere throughout the works.

Therefore, any work undertaken before an Award has been established could be at risk of disputes or legal action, while removing many of the protections the Award is designed to provide for both parties.

What if my neighbour refuses the proposed works?
If your neighbour dissents from your proposed party wall works, this does not necessarily prevent you from going ahead with them. In these cases, party wall surveyors can be appointed on both sides to discuss and prepare a legally binding Party Wall Award that sets out how the works should proceed while protecting the rights and interests of both parties.

I am a returning client of Stokemont, which is a professional company that delivered a thorough level 3 full house survey report. Surveyor Seyi did a great job and exceeded my expectations; the report is comprehensive and offered good advice. I would recommend Stokemont to my friends.

I used Stokemont to undertake party wall surveys on my neighbours addresses and I found them to be really professional. Bradley regularly kept me up to date with information and next steps and answered any queries in timely manner too. Everything including costs etc were clearly set out so I couldn’t ask for anymore from start to finish. Highly recommend and price wise were cheaper than a number of surveyors I enquired with.

I hired Stokemont for a full Level 3 building survey on a flat I was purchasing in London. The turnaround was very quick and the report was extremely detailed — covering everything from minor cosmetic issues to more significant defects. Seyi flagged a gas supply issue that turned out to be significant, and without the survey I would not have known about it or been able to negotiate appropriate protection before exchange. As a first-time buyer I found the report really helpful and would strongly recommend Stokemont to anyone purchasing a property.

We would thoroughly recommend Stokemont to anybody requiring a boundary determination report. Having had a very poor experience with another firm of surveyors who promised a report in 10 days, but only managed an error-filled report in 30 days, Seyi Omogbehin promised a report within 5 days and delivered a very thorough, highly professional report within 2 days. Stokemont, and Seyi in particular provided an excellent service from start to finish.
