In this weeks property surveying blog post, we are going to be discussing Party Wall Notice response options, and the options that are available to you should you receive a Party Wall Notice from your adjoining owner.
If you have been served a Party Wall Notice by your neighbour, in the first instance, you have three party wall responses open to you.
Option 1 – consenting to the Party Wall Notice
Should you choose to consent to the Party Wall Notice, you will effectively be waiving your party wall rights, and effectively be giving your neighbour/building owner the right to proceed with their proposed party wall works without any further formalities or procedures being followed.
Should you select this, the party wall procedures effectively be paused/halted with no further formalities being followed.
Option 2 – Dissent and appoint your own Party Wall Surveyor
Should you select this option, in dissenting and appointing your own surveyor, effectively you are requesting a party wall surveyor to review the proposed works in the perspective of your property. Part of the surveyor’s role will be to ensure that those works pose the least amount of risk as possible to your property, ultimately ensuring the risk and issue associated with those works is as low as it could possibly be.
Option 3 – Dissent and appoint an Agreed Surveyor
Should you choose to dissent and appoint an agreed surveyor, you will effectively be requesting that one surveyor acts impartial in respect of both you and your neighbouring owner, thereby ensuring the procedures are correctly followed to ensure that the party wall procedures are not only impartially administered, but ultimately that you have an agreed award in place that fairly and reasonably represents both yours and their interests.
