In this week’s Property Surveying blogpost, we are going to be discussing Party Wall Surveying matters, and in particular if a Building Owner, whom is the Owner undertaking the proposed construction works, is required to pay for their Adjoining Owner’s/Neighbouring Owner’s Party Wall Surveyor’s fee.
The Party Wall etc Act 1996 governs this type of scenario, and effectively sets out that any Owner who is undertaking construction works to their property, that fall within the realm of the Party Wall etc Act 1996, must serve a Party Wall Notice a minimum of two months in advance of the works commencing upon the Adjoining Owner.
If the Adjoining Owner opts to dissent to the Party Wall Notice, thereby meaning that they are formally requesting the input of a Party Wall Surveyor, to represent their interest, then in this case, the Building Owner, would be responsible for that Party Wall Surveyor’s reasonable costs.
The Party Wall Surveyor’s role, will be to look at the works from the perspective of the Adjoining Owner’s property, ensuring that those works posed the least amount of risk as possible, and ultimately ensuring that there is a legally binding and enforceable Party Wall Award in place, that would not only protect their Appointing Owner, the Adjoining Owner, but would also protect the Building Owner as well.
Party Wall Surveying procedures can often be a confusing topic for Building Owners, and in many cases they may find themselves unaware of their legal requirements, until very late on in the day.
