Adjoining Owner Party Wall Notice Responses?

Thank you for clicking on today’s Party Wall Surveying blog post topic. Through our weekly blog posts, we aim to not only advise and inform both our clients and the general public, we also aim to address some of the more complicated and complex parts of the Property Surveying work that we undertake on a daily basis.

In today’s blog post topic, we are going to be looking at one of the most common questions were asked as Party Wall specialists here at Stokemont.

This blog is written for those adjoining owners who have received a Party Wall Notice!

At this moment in time, you would have received a Party Wall Notice from an appointed Party Wall Surveyor on behalf of one of your neighbours. In this Party Wall Notice, it will outline the name and address of the building owner, signed by the building owner or the appointed Party Wall Surveyor and should include details as well as a description of the works they intend to carry out.

Once you have done your due diligence on the proposed works, you are then left with a choice on how to respond to the Party Wall Notice.

Essentially speaking, there are 3 choices in which you can choose to respond to this.

  1. The first being, consenting to the Party Wall Notice.
  • The second being dissenting to the Party Wall Notice and appointing the surveyor who served the Notice.
  • The third being dissenting to the Party Wall Notice but appointing your own surveyor

Consenting to the Party Wall Notice

Consenting to the Party Wall Notice means that you are giving the green light to the building owner to commence the proposed building works. This Is the best outcome for the building owner as they can start building works without delay as well as not incurring any further costs in the Party Wall procedures.

However, if consent is given to the Party Wall Notice, you as the adjoining owner, should be made aware that you will not benefit from any of the protections given in the Party Wall etc Act 1996.

Dissenting to the Party Wall Notice

Dissenting to the Party Wall Notice and appointing the Party Wall Surveyor who served Party Wall Notice will include a Schedule of Condition Report as well as a Party Wall Award.

A Schedule of Condition Report will be the Party Wall Surveyor coming round to your property and noting any defects within proximity of the proposed works before works have commenced.

Once the Schedule of Condition Report is complete a Party Wall Award, or otherwise known as the Party Wall Agreement, also known as a Party Wall Award, will be drafted and served to protect both respective owners (the building owner and adjoining owner) in an event of any issues arising from the works, such as damage.

Dissenting to the Party Wall Notice and appointing your own Party Wall Surveyor is very similar to the second option. This will also include the Schedule of Condition Report as well the Party Wall Award. However, one of the major differences will be the two appointed Party Wall Surveyors working together to conclude on the Party Wall Award.
